The Senior CDD/AML Advisor supports the Regional Head of Financial Crime Compliance (FCC) CRM and the Country Head of FCC (Ghana) in the area of Customer Due Diligence; ensuring that Ghana is in compliance with the procedures, and managing the related risks which arise from specific clients, as well as ensuring effective escalation of the higher risk relationships.

Key Roles and Responsibilities

·         Provide subject matter expertise, drawing on FCC networks, professional qualifications and experience to advise on CDD policy, escalation of higher risk relationships and testing compliance with policy in the region

·         Advise on the Bank’s sanctions risk management framework as it applies to client relationships

·         Assess risks arising from specific clients and managing those risks in the interests of the Bank

·         Undertake other hubbed CDD review activities

·         Review Politically Exposed Persons (“PEP”) files and sensitive client files

·         Integrate data across processes managed in Controls relevant to the CDD review

·         Escalate issues requiring business rejection/restriction

·         Conduct ongoing testing of compliance with the CDD procedures

Qualifications and Skills

·         A good first degree in any discipline. A second degree will be an added advantage.

·         The role holder needs to possess knowledge of the laws applicable to money laundering, to include the BSA, OFAC/HMT requirements, CISADA, and Suspicious Activity Reporting (SAR) requirements.

·         Should be able to manage conflict arising out of the Customer Due Diligence (CDD) review activities amicably

To support the Regional Head of Sustainability Africa (RHSA), by effectively and efficiently working with both internal and external stakeholders to deliver the Bank’s Sustainability agenda and initiatives for the Africa Region,

As a key member of the Ghana team (and West Africa CA team), to efficiently and effectively support the CA function in Ghana by ensuring that the Bank’s agenda in the areas of Public Affairs, Internal and External Communications, Sustainability and Issues Management are well implemented in order to support staff engagement, profile the Bank as a market leader, to build on its image and profile and to maintain good relations with all stakeholders.

Key Roles & Responsibilities
Working closely with the RHSA, deliver on the following:

Sustainability

·        Plan and execute the Bank’s Sustainability agenda in line with the strategy for Africa and the Group

·        Support the delivering and reporting on community activities and ensuring that they remain within budget

·        Develop the Sustainability Key Messages capturing the Bank’s socio-economic impact in all its markets in Africa and ensure that is deployed in the internal and external communications effort

·        Support the use of Employee Volunteering (EV) for staff engagement and external stakeholder engagement

·        Ensuring country and businesses teams comply with the sustainability policies of the Bank and work with business heads to lead effective stakeholder engagement programs

·        Providing sustainability coordinators and country committees with the right tools and advice to be able to deliver the sustainability agenda of SCB

·        Providing strategic advice to country Mancos and business heads on how best to deliver sustainability initiatives

·        Remaining current about best practices – liaising with local NGOs and key stakeholders to ensure that the sustainability issues remain relevant to the communities in which we operate

·        Push back on sustainability initiatives that while worthwhile do not deliver the Bank’s sustainability agenda

  • Work with other CA functions to ensure the sustainability agenda and achievements are well understood internally and externally


Working closely with the Head Corporate Affairs, Ghana (HCA), deliver on the following:

External Communications & Media Relations

·        Plan and implement a country-focused external communications strategy to deliver the Bank and the Group’s key messages effectively

·        Establish and maintain personal contacts with editors and key journalists from major local and international media

·        Ensure the Bank maintains a high share of voice in the media

·        Ensure discipline, “One Voice” and adherence to brand guidelines and Group policy in the area of communications with external stakeholders

·        Work closely with internal stakeholders in order to deliver on their external communications needs

·        Monitor and manage trends and developments in the use of the media, and facilitate media relations audits which include competitive analysis

·        Ensure that the external website delivers up-to-date information on the Ghana franchise and that it becomes a relevant reference point for the visitors

·        Ensure appropriate training for spokespeople and ensure access to the press is controlled

  • Develop country key message documents and maintain key data points that back up the strategic business plan


Internal Communications

·        Plan and implement an effective internal communications strategy and structure within the country

·        Establish and maintain personal contact with all function heads in order to deliver tailor-made communications for their teams

·        Ensure discipline, “One Voice” and adherence to brand guidelines and Group policy in the area of internal communications

·        Work closely with internal stakeholders in order to deliver on their internal communications needs

·        Successfully introduce innovation in the internal communications effort in order to support staff engagement

·        Ensure that iConnect delivers up-to-date information on Ghana and that it becomes a relevant reference point for the staff

  • Conduct regular internal communication audits to gauge effectiveness of channels used and whether messages are understood


Public Affairs (i.e. Government Relations)

·        Assist HCA track political, economic and social issues relevant to SCB and its reputation

·        Contribute towards the maintenance of the bank’s neutral position in political, religious and other equally sensitive situations

4 . Legal Counsel, Corporate & Institutional Clients, Africa

To assist Corporate & Institutional client businesses execute transactions in Africa and to support products covered by the C&I segment (including Corporate Finance, Transaction Banking and Financial Markets). Is responsible for legal transactions and issues in relation to Corporate & Institutional client businesses. The role holder provides legal advice and transactional support to the relevant business and is responsible for driving the business forward. The role will have overlap with compliance elements and the role will require the candidate to provide compliance support on transactional and product matters together with compliance officers within the bank.
Business Partnering
Executes transactions and cases in a timely and effective manner for the C&I segment across the region.
Corporate & Institutional client business types to be supported include (amongst others) lending, corporate finance, project finance, private equity, trade finance, structured trade finance, trade, cash, financial markets (including in part some vanilla derivative products).
Effectively manages the process of engaging external counsel, including providing effective instructions to external counsel and negotiating appropriate fee structures for the transaction / case in question.
Supports and facilitates internal product development through the new products approval process.
Develops appropriate forms of documentation for products and transactions in the country and region and, where required, supports the creation of global standard documentation.
May be regarded as a key contact in relation to particular area(s) of product specialism.
Uses technical knowledge of all business products undertaken in the jurisdiction to provide sound, technical product, legal and transactional advice to the business and to anticipate the impact of legal developments on the business and communicate such impact to the business.

Legal and Product Risk

* Many issues which arise in the course of drafting or negotiating documentation are not legal issues but involve aspects of credit, market, event or operational risk. The Legal Counsel must be able to understand the nature of these risks and contribute to the processes that mitigate these risks.
* Negotiation of document often requires a judgement decision in which a balance must be struck between the interests of doing business and of protecting the bank. Even though the Legal Counsel may not make this decision solely, he/she must be able to make a meaningful recommendation and to provide the decision-maker with sufficient information in order to make an informed decision.
* The Legal Counsel must be able to adapt his/her approach to a range of legal systems which may differ considerably from the system he/she was trained in.
